You had been out to the club, a party, or even just a friend’s house and had a few drinks. You didn’t think about it when you got in the car to drive home, but you sure did when you saw the flashing lights on the police car behind you. Am I drunk? Am I wasted? Am I driving under the influence? Am I driving while intoxicated? Too late then; instead it’s time to think about calling a DUI Lawyer.
Anytime some one is arrested for anything the first thing, and last thing, out of their mouths should be “I want a Lawyer”. An arrest for DUI or DWI is the same thing. Do not say anything, except “I want a Lawyer”. If you already have a lawyer, or a pre-paid legal card, give them that name, but do not say anything else. Why? Anyone who has watched any crime shows on TV knows why; “Anything you say can be used against you in a court of law”.
Twenty or thirty years ago, DUI was not a big thing, as long as no one was hurt or you did not cause an accident. It was a night in jail to sober up, a small fine, points on your license and maybe a mandatory DUI Class. As long as you did not make a habit of getting caught it was not a big thing.
Today things are much different. In many jurisdictions, significant jail time can be given for a first time offense. Some insurance companies routinely cancel car insurance for any DUI or DWI conviction; all of them will increase your rates. Fines are hefty in most courts, and convictions frequently carry community service requirements. There are almost always extensive and costly training classes to attend. For subsequent convictions things get progressively worse very quickly.
What can a DUI Lawyer do to prevent all of this? First off, the lawyer can make sure that the police and prosecutor have gotten all of the procedures correct. Even minor mistakes can get a case thrown out of many courts. In many jurisdictions a good DUI Lawyer can get the case brought before a judge that is more lenient or understanding about first time offenders. He may be able to get a No Contest plea accepted, which may allow the judge to ignore many of the mandatory sentencing requirements. A plea deal may even be possible depending on the circumstances. There are no guarantees, but without a lawyer there is no chance.
More importantly, asking for a DUI Lawyer stops the police from questioning you any further. It helps to keep you from talking your way into more problems. It helps to reduce the chance of you getting belligerent and getting additional charges added to the DUI or DWI charge. Additional charges that will certainly make it difficult or impossible to get any leniency when you go before the judge.
Remember these words; “I want a lawyer.” Repeat them often. If you get arrested for DUI or DWI, they should be the first and last words out of your mouth. Life is going to be rough enough for this mistake. Do not make it any worse. A good DUI Lawyer is your only chance in getting any leniency for a DUI or DWI conviction.
